Terms and Conditions for the "O more Mati" Contest by Pitter Yachtcharter
These terms and conditions and data protection notices (hereinafter collectively referred to as "Terms and Conditions") apply to participation in our "O more Mati" Contest.
Organizer
- The sweepstakes are conducted by Pitter Yachtcharter (Pitter GesmbH).
- This sweepstakes is not associated with Facebook. It is not sponsored, supported, or founded by Facebook and does not create any legal claims against Facebook. All information provided in the context of this sweepstakes is solely provided by Pitter Yachtcharter (Pitter GesmbH).
- Any questions, comments, or complaints about this sweepstakes should be directed to Pitter Yachtcharter or the Facebook address of Pitter Yachtcharter (Pitter GesmbH).
Prize
In the "O more Mati" Sweepstakes, Pitter Yachtcharter is giving away a charter week on a 3-cabin yacht in May/June 2025. The prizes are non-transferable and not redeemable for cash. Booking is subject to availability.
Participation and Participation Period
How to participate: Take a photo of yourself helping to keep our environment clean. Go to our Facebook page and post your photo in the pinned post above. Our base staff will be happy to provide you with our eco-friendly "O more Mati" bags for trash collection at the start of your cruise.
Participation is possible from the appearance of the corresponding Facebook post. The sweepstakes end with the official end of the season 2024 (October 30, 2024).
- A person participates in the sweepstakes by uploading a photo on the Pitter Yachtcharter Facebook page.
- Participation is only possible once per person.
- The participant is responsible for compliance with privacy, data protection, and copyright of their photo and video content.
- The minimum age for participation is 18 years.
- Employees and partners of Pitter Yachtcharter and companies associated with Nautic Alliance Holding GmbH are not eligible to participate.
- Legal recourse is excluded. A cash payout or substitution of the prize is not possible.
Execution and Handling
Winners will be determined after the participation period among all participating persons.
- Winners will be informed via Facebook and asked to send their name, first name, and postal address to Pitter Yachtcharter via a personal message.
- Winners agree that their names and their content (photo or video material, etc.) may be used for advertising purposes and published on the Pitter Yachtcharter homepage and the companies associated with Nautic Alliance. "Content" in the context of these terms and conditions refers to all content and information uploaded, entered, or otherwise communicated by participants in connection with the sweepstakes, such as photos, graphics, videos, texts, comments, or details of places and persons. This means a non-exclusive, royalty-free license for the use of the content is granted. The image rights remain with the sender, and all persons depicted in the photos explicitly agree to the use and utilization of the uploaded content.
- If the winner does not respond within four weeks of sending the notification, the claim to the prize expires, and a new winner will be determined.
- Any additional costs (e.g., pick-up or travel expenses) incurred by claiming the prize will not be covered by Pitter Yachtcharter.
Warranty Disclaimer
Pitter Yachtcharter points out that the availability and functions of the sweepstakes cannot be guaranteed. The application can be terminated and removed at any time without giving reasons, without any claims arising from the participants against Pitter Yachtcharter.
Final Provisions
- Legal recourse: Legal recourse is excluded with regard to the drawing of winners and any assessment of the entries submitted.
- No correspondence will be conducted about the sweepstakes.
- Only Austrian law applies.
We process personal data (hereinafter also referred to as "data") of sweepstakes participants only in compliance with the relevant data protection regulations, insofar as processing is necessary for the provision, execution, and handling of the sweepstakes (Art. 6 para. 1 sentence 1 lit. b. DSGVO), or the participants have consented to the processing (Art. 6 para. 1 sentence 1 lit. a DSGVO). Participants have various rights as data subjects under the DSGVO, in particular arising from Art. 15 to 21 DSGVO:
- Right to Object: You have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you that is carried out based on Art. 6 para. 1 lit. e or f DSGVO; this also applies to profiling based on these provisions. If personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing purposes; this also applies to profiling, insofar as it is related to such direct marketing.
- Right of Withdrawal of Consents: You have the right to withdraw consent at any time.
- Right of Access: You have the right to request confirmation as to whether relevant data is being processed and to information about this data, as well as further information and a copy of the data in accordance with legal requirements.
- Right to Rectification: You have the right, in accordance with legal requirements, to request the completion of data concerning you or the rectification of incorrect data concerning you.
- Right to Deletion and Restriction of Processing: You have the right, in accordance with legal requirements, to request the immediate deletion of data concerning you, or alternatively, in accordance with legal requirements, to request the restriction of processing of the data.
- Right to Data Portability: You have the right to receive the data concerning you, which you have provided to us, in a structured, common, and machine-readable format, in accordance with legal requirements, or to request its transfer to another responsible party.
- Right to Complain to a Supervisory Authority: You also have the right, in accordance with legal requirements, to lodge a complaint with a supervisory authority, particularly in the Member State of your habitual residence, your workplace, or the location of the alleged infringement, if you believe that the processing of personal data concerning you violates the DSGVO.
